It is important that the tribunal for the crime of aggression against Ukraine was established internationally – Oleh Havrysh

Several options for creating a special tribunal for the crime of aggression against Ukraine are currently being considered. There are other options, including through the UN General Assembly. However, it is very important for the tribunal to be established internationally.

It was emphasized by Oleh Havrysh, Chief Consultant of the Department of Organizational Work of the Cabinet of the Head of the Office of the President of Ukraine, during a discussion at the main discussion platform BrainHub at the Media Center Ukraine – Ukrinform. 

“It is important for us to get the Nuremberg-style tribunal response. It is very important for us that this is an option when countries or a group of countries, or through voting in the UN General Assembly, support us, and this tribunal exists internationally,” he said.

In his turn, Anton Korynevych, Ambassador at Large of the Ministry of Foreign Affairs of Ukraine, emphasized that the issue of creating a special tribunal for the crime of aggression against Ukraine, given its jurisdiction over responsibility for the crime of aggression against Ukraine, is one of the critical issues when it comes to ensuring justice and fairness.

He noted that among the four categories of the most severe international crimes against international law, there is a gap in one of them—the crime of aggression.

“There is a gap regarding the crime of aggression. Currently, there is no international tribunal or court that has jurisdiction over the crime of aggression. So there is a gap, and we need to fill it. Especially given that responsibility for crimes of aggression against Ukraine is essentially responsibility for this entire war, as such, Russia’s war against Ukraine. Because the crime of aggression is the individual responsibility of Russia’s highest political and military leadership for committing acts of aggression, that is, for waging the aggressive war against Ukraine,” the ambassador explained.

Anton Korynevych expressed his belief that an extraordinary tribunal with jurisdiction to investigate and prosecute the crime of aggression against Ukraine is needed. He noted that this task has been underway for a year and a half, with good interim results.

In addition, Anton Korynevych added that the creation of a special tribunal, its functioning, and its activities are essential not only for Ukraine to bring the leaders of the aggressor state to justice but also to enforce international criminal law.
