The Special Tribunal will be unique, just like the war it will prosecute – Anton Korynevych

The Special International Tribunal for the crime of aggression against Ukraine will be unique, not only due to the circumstances of the war, but also because of its legal specifics.

Anton Korynevych, Ambassador-at-Large of the Ministry of Foreign Affairs of Ukraine, emphasized this during a discussion at Media Center Ukraine.

“In any case, it (the tribunal – ed.) will be exceptional because we are dealing with an extraordinary situation – russia’s aggressive war against Ukraine, a conflict unseen in Europe for over 80 years. It is only natural that this tribunal should be unique. Throughout human history, most tribunals have differed from one another, and only a few have been similar. This tribunal will stand out by focusing solely on one crime within its jurisdiction: the crime of aggression. But this is normal, as other jurisdictions exist. It will be the first tribunal of its kind since Nuremberg and Tokyo, drawing parallels between the 1940s and today,” the diplomat explained.

He stressed that the tribunal’s establishment should not be delayed until the end of hostilities.

“We want and envision this tribunal being created now, while the war continues. There is no need to wait until it ends,” Korynevych emphasized.

He also highlighted the key characteristics of the future tribunal and noted that it will operate as a self-governing international body with its own legal personality, free from external influence, and empowered to make autonomous decisions.

Additionally, according to Korynevych, the tribunal will be able to make decisions without the accused being present, as one of the tribunal’s special legal characteristics will be its ability to conduct proceedings and pass sentences in absentia.
